Terms and Conditions for acceptance of Statutory/Trustee Notices/Advertisements
effective 29 October 2019
Within these Terms & Conditions, the term ‘Advertiser’ refers to the legal entity (or a successor entity) instructing the ‘Agent’, i.e. Rockwell Legal Notice Advertising (hereafter referred to as Rockwell) to place Statutory/Trustee Notices/Advertisements (of which the name may not necessarily be that shown in the Statutory/Trustee Notice/Advertisement). The term ‘Publisher’ refers to any third-party publishing entity which Rockwell engages in the publication of Statutory/Trustee Notices/Advertisements, on the Publisher’s terms, on behalf of the Advertiser. Rockwell Legal Notice Advertising refers to the advertising service provided by Rockwell. Rockwell is not the Advertiser. The professional firm/individual who contracts the services of Rockwell is the Advertiser. Rockwell remains the Agent in these circumstances.
The registered name and registered office of the professional firm (the Advertiser), whether or not for publication, must accompany each advertisement instruction. Likewise, private individuals must also provide bona fide name and address details of themselves and that of the deceased they are representing.
Rockwell only accepts Statutory/Trustee Notices/Advertisements that comply with the Advertising Standards Codes of the Committee of Advertising Practice and statutory provisions in any area of the UK in which an advertisement may be published/distributed. All Statutory/Trustee Notices/Advertisements must conform to those requirements laid down by the Publisher.
Rockwell reserve the right to cancel or withdraw a Statutory/Trustee Notice/Advertisement if it deems to breach these provisions.
Rockwell makes every effort to meet the instructions/requests of its Advertiser/Client firms. Rockwell or the Publisher cannot guarantee the insertion or position of any particular Statutory/Trustee Notice/Advertisement in a specific publication due to the limited availability of space on any specific date.
It is the responsibility of the Advertiser (Client) to check the information/details and content of any Statutory/Trustee Notice or advertising instructions provided to Rockwell and/or also any proof of a Statutory/Trustee Notice/Advertisement that the Agency may supply to the Advertiser (Client). Rockwell assumes no responsibility for any errors unless notified by the Advertiser (Client), or private individual at the earliest reasonable opportunity.
The Advertiser (Client) agrees to consider any errors/discrepancies that Rockwell might bring to the client’s notice in the process of checking detail applied to each Statutory/ Trustee Notice/Advertisement, and accepts that total responsibility for accuracy and compliance with the statutory legal requirements of a Statutory/Trustee Notice/Advertisement rests with the Client/Advertiser.
Credit is offered to all recognised professional firms. Advertisements on credit will be due for payment within 30 days from date of invoice. Rockwell will send an invoice for each Statutory/Trustee Notice/Advertisement instruction, after publication of the Notice(s) and on receipt of a printed voucher copy or cutting of the Notice/Advertisement. Payment terms are shown on our Invoices. Credit is offered to an Advertiser (Client) when agreed by Rockwell. If our credit terms are breached, we reserve the right to withdraw credit facilities without prior notice. In the event of non-compliance with our credit terms Rockwell reserve the right to demand payment of the full balance of the account including any invoices not yet issued.
Cheques should be made payable to ‘Rockwell Legal Notice Advertising’ and sent to the address on our invoice. If you prefer to make payment by BACS, our bank details will be supplied to you.
The Advertiser (Client) guarantees to Rockwell that Statutory/ Trustee Notices/Advertisements are not of a defamatory nature as could cause damage, injury or distress to any person, except where such Statutory/Trustee Notices/Advertisements may be incidentally caused by factual content permitted to be included by statutory requirements and not prohibited by any order made by a Court of Law.
Rockwell plan for all Statutory/Trustee Notices/Advertisements to be published on the agreed dates. Rockwell does not accept liability in the event of non-publication of a Statutory/Trustee Notice/Advertisement resulting from industrial action, print or digital production problems, extreme weather situations or any other external factor over which Rockwell has no reasonable control. If a Statutory/Trustee Notice/Advertisement is not published on the date specified, Rockwell will advise the Advertiser (Client) of the next available date. Rockwell accepts no liability in respect of costs, legal costs, expenses, demands, claims or any other matter arising from an error in the publication of a Statutory/Trustee Notice/Advertisement or failure to publish an advertisement, except for the cost of the insertion of the advertisement.
The placing of a space order for a Statutory/Trustee Notice/Advertisement by the Advertiser (Client) shall be deemed to be acceptance of the above conditions. Any conditions set out on an Advertiser’s (Clients) instructions that differ in any way from this document shall be void.
The Advertiser (Client) agrees to indemnify Rockwell and the Publisher against any costs, claims, actions, demands or proceedings arising out of non-compliance with the matters set out in these Terms and Conditions.
The Rockwell website or any part of it must not be copied or reproduced or stored on any other website or included in any private or public electronic retrieval system without written permission from Rockwell.
Rockwell will endeavour to make our website available 24 hours a day 365 days a year. Access to the Rockwell website may not be accessible for a temporary period due to maintenance, be suspended on a temporary basis and without notice due to system failure, repairs or maintenance, or for other reasons out of our control. We will not be held liable if, for any reason, the website is not available for any period.
Rockwell will endeavour to keep information found on the Rockwell website correct and up to date. Rockwell may revise the content on its website from time to time and without prior notice.
